It’s a public order offence, focusing on protecting bystanders from threatening situations and is distinct from other violent offences by requiring that a third party, not directly involved, feels endangered.


    The offence was fundamentally developed for the protection of public order and the public against unlawfulness. The affray charge is designed for the protection of the bystander and envisages three distinct parties.

  • What Are the Penalties for Affray?

    Affray carries severe penalties, including the possibility of up to 10 years in prison. However, if the case is heard in the Local Court, the maximum prison sentence that can be imposed is two years. Still, the Local Court must consider the maximum penalty when determining the appropriate sentence.
