The prospect of being charged with affray is a frightening experience, especially as it carries severe penalties if a conviction is recorded. But with Kells’ experienced affray lawyers in Sydney on your side, you’ll receive clear, professional guidance on your options along with a well-crafted defence strategy based on your circumstances. Our team, which is led by a former police officer and prosecutor, will work closely with you so you can achieve the best possible outcome.
Affray is typically charged when aggressive conduct in a group causes an uninvolved bystander to fear for their safety. It’s a public order offence, focusing on protecting bystanders from threatening situations and is distinct from other violent offences by requiring that a third party, not directly involved, feels endangered.
The offence was fundamentally developed for the protection of public order and the public against unlawfulness. The affray charge is designed for the protection of the bystander and envisages three distinct parties.
Affray carries severe penalties, including the possibility of up to 10 years in prison. However, if the case is heard in the Local Court, the maximum prison sentence that can be imposed is two years. Still, the Local Court must consider the maximum penalty when determining the appropriate sentence.
