Life changes over time, and your estate plan should reflect those changes. Major life events such as marriage, divorce, the birth of children, or even financial changes can affect how you want your assets managed or distributed. Failing to update your estate plan could potentially lead to unintended consequences for your loved ones or leave your wishes unclear.
At Kells, we are here to help you update your estate plan to ensure it continues to meet your needs and goals. Our experienced estate planning lawyers in Sydney are here to provide the legal services you need to keep your estate plan fit for purpose.
Regular reviews are necessary to ensure that your plan aligns with changes in your life, such as new family members, shifts in financial circumstances, or updates to legal requirements. Keeping your estate plan up to date is key to protecting your assets and ensuring your wishes are carried out.
At Kells, we offer estate planning check-ups that take into account:
Working with an experienced lawyer can help identify opportunities to improve your estate plan. Changes in the economy, your personal circumstances, or your assets may create the need for updates. A lawyer can also explore strategies to maximise tax savings. The goal is to ensure that as much of your hard-earned wealth as possible is passed on to those you care about.
Below are some of the matters we can help you with:
Did you know that not all of your assets are distributed through your Will after your death? Without proper planning, this can lead to unintended benefits for certain beneficiaries, unnecessary tax liabilities, or even the loss of a pension entitlement.
Is your home jointly owned with your spouse or partner? Transferring assets to joint ownership or non-estate ownership can provide better asset protection and help reduce future legal costs. In New South Wales, stamp duty is no longer payable when transferring a half interest in your home to your spouse or partner. This may make it worthwhile to consider transferring a joint interest now.
Kells can assist you with these decisions and provide legal advice based on your specific situation.
Superannuation is one of the most significant assets for many Australians. Do you know who your death benefit recipients are? What level of discretion does your Superannuation Trustee have in distributing these benefits? Would it be beneficial to make a legally binding nomination to ensure your wishes are followed?

We offer clients a free service to store their original documents in our secure strongroom for safekeeping.
If you wish to retrieve a document from our strongroom, you are welcome to do so at any time. If someone else needs to collect a document on your behalf, you must provide them with written authority and a certified copy of your identification.
We recommend keeping copies of your documents in a safe place at home or in a safe deposit box if you have one. It is also important to inform your executors, attorneys, and guardians that we are holding the originals in our secure custody.
